These Terms & Conditions apply to purchases made through averyandwyld.com.
Please read them carefully before placing an order.
By placing an order with Avery & Wyld, you agree to these Terms & Conditions.
1. About us
This website is operated by Avery & Wyld Ltd, a company registered in England and Wales.
Throughout these Terms & Conditions, references to “Avery & Wyld”, “we”, “us” and “our” refer to Avery & Wyld Ltd.
2. Our products
We take care to describe and photograph our products as accurately as possible.
However, colours may appear slightly different depending on your device, screen settings and lighting.
As some of our products incorporate natural materials, including wood, variations in colour, grain and appearance may occur. These natural variations are part of the character of the material and are not considered defects.
Product dimensions and measurements are approximate unless expressly stated otherwise.
3. Product safety
Avery & Wyld products must always be used in accordance with the instructions and safety information supplied with the product.
Our decorative nursery mobiles are intended to be positioned securely and kept out of a baby's reach.
They are not toys and should not be handled or played with by babies or children.
Customers are responsible for ensuring products are correctly and securely installed and used only for their intended purpose.
Please discontinue use immediately if a product becomes damaged, loose or otherwise unsafe.
Nothing in these Terms limits or excludes our responsibility to supply products that meet applicable UK product safety requirements.
4. Placing an order
When you place an order through our website, you are making an offer to purchase the products in your order.
After placing an order, you will receive an order acknowledgement or confirmation by email.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:

a product is unavailable;

there has been an obvious pricing or product-description error;

we are unable to authorise or verify payment;

we suspect fraudulent or unauthorised activity; or
-
we are unable to deliver to the address provided.
If payment has already been taken for an order we subsequently cancel, we will issue a refund.
5. Prices and payment
All prices are displayed in the currency shown on our website.
Where applicable, prices include UK VAT.
Delivery charges and any other applicable charges will be displayed before you complete your purchase.
Payment must be made using one of the payment methods available at checkout.
6. Pre-orders
Certain Avery & Wyld products may be made available for pre-order before stock is ready for dispatch.
Where a product is offered for pre-order, this will be clearly stated on the relevant product page.
Any estimated dispatch or delivery date provided for a pre-order is an estimate rather than a guaranteed delivery date unless expressly stated otherwise.
Manufacturing, freight, customs or other circumstances outside our reasonable control may occasionally affect anticipated timelines.
If there is a significant delay to your pre-order, we will contact you using the email address supplied with your order and provide updated information.
Your statutory cancellation and refund rights are not affected by purchasing an item on pre-order.
If an order contains both pre-order and in-stock products, we may dispatch the order together once all items are available unless otherwise stated at checkout.
7. Delivery
We will deliver your order to the delivery address supplied at checkout.
Estimated dispatch and delivery times shown on our website are provided in good faith but may occasionally be affected by circumstances outside our reasonable control.
Once your order has been dispatched, you may receive tracking information where this service is available.
Please ensure that your delivery information is accurate before completing your order.
If an order is returned to us because an incorrect or incomplete delivery address was supplied, additional delivery charges may apply before it can be resent.
8. International orders
Where international delivery is available, customers are responsible for ensuring that the products they purchase can lawfully be imported into their destination country.
Depending on the destination and the shipping service offered at checkout, customs duties, import taxes or other local charges may apply.
Where such charges are not expressly included in the price paid to Avery & Wyld, they will be the responsibility of the customer.
International delivery times may also be affected by customs processing and other circumstances outside our control.
9. Your right to cancel
If you are a consumer purchasing online in the UK, you will generally have the legal right to change your mind and cancel your order within 14 days of receiving your goods, subject to applicable exceptions.
To exercise your right to cancel, please contact us within the applicable cancellation period.
You then have 14 days from notifying us of your cancellation to return the goods.
Your statutory rights are not affected by these Terms.
10. Returns
Returned products should be:

unused;
-
in their original condition; and
-
returned with their original packaging where reasonably possible.
You are responsible for taking reasonable care of products while they are in your possession.
We may make a deduction from a refund where the value of a product has been reduced as a result of handling beyond what would reasonably be necessary to establish its nature, characteristics and functioning.
Unless the product is faulty, damaged or incorrectly supplied, the cost of returning an unwanted product is the customer's responsibility.

11. Faulty or damaged products
We take great care in preparing Avery & Wyld products for delivery.
If your order arrives damaged, faulty or incorrect, please contact us as soon as reasonably possible and provide your order details and, where appropriate, photographs of the issue.
We will work with you to resolve the matter in accordance with your legal rights.
Nothing in these Terms affects your rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.
12. Refunds
Where a refund is due, it will normally be made using the original payment method.
We will process refunds within the time required by applicable consumer law.
Your bank or payment provider may require additional time for the refunded amount to appear in your account.
13. Promotions and discount codes
From time to time, we may offer promotional codes, discounts or special offers.
Unless otherwise stated:

promotional codes cannot be exchanged for cash;

only one promotional code may be used per order;

promotions may have specific eligibility requirements or expiry dates; and

promotional offers cannot normally be applied retrospectively to completed orders.
We reserve the right to withdraw or amend promotions where reasonably necessary.
14. Intellectual property
All content appearing on the Avery & Wyld website, including our branding, product names, illustrations, artwork, photography, graphics, text, designs and other creative material, is owned by or licensed to Avery & Wyld unless otherwise stated.
You may not copy, reproduce, distribute, modify, commercially exploit or otherwise use our intellectual property without our prior written permission.
15. Website use
You must not misuse our website, attempt to gain unauthorised access to it, introduce malicious software or use the website for unlawful or fraudulent purposes.
We may temporarily suspend or restrict access to our website where necessary for maintenance, security or other operational reasons.
16. Our responsibility to you
We are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
We are not responsible for losses that were not foreseeable or for business losses suffered by consumers.
17. Events outside our control
We will not be responsible for delays or failures caused by events outside our reasonable control.
These may include disruption to transportation, postal or courier networks, customs delays, severe weather, natural disasters, industrial action or other events that could not reasonably have been prevented.
Where such an event affects your order, we will take reasonable steps to minimise its impact and keep you informed where appropriate.
18. Changes to these Terms
We may update these Terms & Conditions from time to time.
The Terms that apply to your purchase will generally be those in force when you place your order.
19. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you will continue to benefit from any mandatory protections provided by the laws applicable to you.
Nothing in these Terms limits any rights you have under applicable consumer law.
